Jackie DiColo at Superior Court!

As an associate at BKW Family Law, Jackie DiColo has been integrally involved in a potential landmark case with a same-sex married couple who decided together to have a child via in vitro fertilization during their marriage. In this matter, the birth mother has unlawfully withheld the child from our client since he was born in May of 2022, despite our client being a legal parent as decided by the Philadelphia Court of Common Pleas. The case was brought up on appeal by the birth mother and heard in February 2023.

Jackie was in Harrisburg, Pennsylvania this week for a reargument en banc before the Superior Court. She has spearheaded this important case on behalf of our client, who has tirelessly been fighting to see their child since his birth. A decision in this matter will be significant not only for the LGBTQIA+ community, whose rights are repeatedly in need of protection, but will also impact most married couples with fertility challenges. We are proud to say that Jackie’s unfaltering dedication and hard work on this important case for our client is with the full support of our firm, which strongly believes in a parent’s right to be a part of their child’s life.

Jackie was also supported in this endeavor by interested colleagues including Helen Casale and Kyle Victor, who submitted an amicus brief in the matter (pictured with Jackie, Eileen, and Joni of BKW Family Law at the courthouse for oral argument).
